Transport Act 2000 and Transport (Scotland) Act 2001
Part 3 of the Local Transport Bill that is currently being considered by Parliament makes a number of important amendments to the Transport Act 2000 and, in particular, to the competition test contained in Schedule 10 of the Transport Act 2000.
These changes will need to be reflected in the guidance published by the OFT once the Local Transport Bill becomes law.
The OFT has published draft competition guidance (December 2007) to inform the parliamentary debate. Further details can be found in the consultations section.
This guidance will eventually, once it has been agreed and subject to formal consultation, replace the existing Transport Act 2000 guideline (OFT 393).
The frequently asked questions on competition law and the bus industry (FAQ's) will also be updated to reflect the changes to the Transport Act 2000. In the meantime, the FAQ's have been temporarily removed from the OFT website pending their revision (as has the brief guide to the role of the OFT in the bus industry).
