Courts and Legal Services Act 1990 and Law Reform (Miscellaneous Provisions) (Scotland) Act 1990
The Office of Fair Trading has duties under the Courts and Legal Services Act 1990 (as amended by the Access to Justice Act 1999) and the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990. It is required to look at the rules of bodies seeking or holding rights of audience in the courts or the right to conduct litigation, and to advise the Lord Chancellor or the Secretary of State for Scotland as to the effect of such rules on competition.
After considering the OFT's advice, these Ministers will then decide whether to approve the rules in question.
