Summary
The OFT, has conducted a review of the undertakings given to the CC by Yell Group plc (now known as hibu plc), a supplier of Classified Directory Advertising Services (CDAS) in the UK, in April 2007. The OFT has found that undertakings given by Yell relating to its Yellow Pages business may no longer be appropriate and has recommended that the CC should consider releasing the company from them.
The CC is now responsible for deciding on any changes to the undertakings.
These undertakings were signed in April 2007, following a CC inquiry into the supply of CDAS, which found that there are features of the relevant market that prevent, restrict or distort competition. The CC's report was published on 21 December 2006.
Under Section 162 of the Enterprise Act 2002 the Office of Fair Trading (OFT) has a duty to review undertakings to consider whether there has been a change of circumstances by reason of which the undertakings might no longer be appropriate and need to be varied or revoked. If there has been such a change, the OFT may advise the Competition Commission (CC) that the undertakings should be varied or replaced, or that the parties should be released from them.
